Filing for Divorce in Colorado
To file for divorce in Colorado, one spouse must have been a Colorado resident for at least 91 days. Colorado is a no-fault divorce state, which means that the only reason that a husband or wife has to give to file for a dissolution of marriage is that the marriage is irretrievably broken. Although the minimum waiting period for finalizing a Colorado divorce is 91 days, many divorce cases—especially ones that require the negotiation of agreements regarding child custody, child visitation, child support, property division, spousal maintenance, parenting rights, or paternity—can take much longer.
Colorado law requires that spouses filing for divorce go through Alternative Dispute Resolution (ADR) to resolve any disagreements before resorting to litigation.
